These Terms & Conditions govern your access to and use of Grail, including the Grail mobile application, website, public sharing features and related services.
Grail is operated by Munchkin Digital Pty Ltd (ABN 62 697 867 824, ACN 697 867 824). In these Terms, “Grail”, “we”, “us” and “our” refer to Munchkin Digital Pty Ltd.
By creating an account or using Grail, you agree to these Terms and our Privacy Policy. If you do not agree to them, you must not use Grail.
1. About Grail
Grail is a platform that helps collectors discover other collectors and arrange trades of trading cards and related collectible products.
Grail may provide trade binders, want lists, card discovery, search, messaging, structured trade offers, postal and in-person trade workflows, public binder sharing, reporting and moderation tools.
Grail is not a party to trades between users. A trade is an arrangement directly between the users involved.
Unless we expressly state otherwise for a particular feature, Munchkin Digital does not buy, sell or take ownership of items traded through Grail, act as an agent for either trader, authenticate items, guarantee that another user will complete a trade, or guarantee the authenticity, condition, grade, value, legality or ownership of an item.
We also do not guarantee the accuracy of information supplied by users, successful postal delivery or the safety of an in-person meeting.
Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded under Australian law.
2. Eligibility
Grail is currently intended for users in Australia.
You must be at least 16 years old to create or use a Grail account.
If you are 16 or 17 years old, you must have permission from a parent or legal guardian before using Grail. By using Grail, you confirm that you have that permission and that your parent or guardian has had an opportunity to review these Terms with you.
- You are under 16.
- You are legally prohibited from using the Service.
- You have previously been permanently banned and have not been permitted to return.
- You intend to use Grail for unlawful or fraudulent purposes.
We may introduce reasonable age-assurance or eligibility measures where required by law or reasonably necessary for user safety.
3. Your account
You may be able to create an account using email, Apple, Google or other sign-in options we make available.
You must provide accurate and current information and must not impersonate another person.
Email verification may be required before certain features become available.
You are responsible for maintaining the security of your account and login credentials and for notifying us promptly if you believe your account has been compromised.
You must not sell, transfer, lend or otherwise provide your Grail account to another person.
We may request additional information or verification where reasonably necessary to protect users, investigate fraud, resolve a report or comply with law.
4. Trade binders, want lists and items
Users may add raw cards, graded cards, sealed products and other supported collectible items to their trade binder or want list.
When uploading or describing an item, you must provide information that is accurate to the best of your knowledge.
- Knowingly misrepresent an item’s identity, set, version, language, condition or grade.
- Conceal material damage or defects.
- Represent a counterfeit or altered item as genuine.
- Use misleading photographs.
- List an item you do not own or are not authorised to trade.
- Offer an item prohibited by these Terms or applicable law.
Where Grail requires actual-item photographs, those photographs should depict the physical item being offered.
Card information, catalogue information, images and reference material supplied through Grail may come from third-party data sources. They are provided to assist users with identification and use of the Service. You remain responsible for checking that the item selected through Grail corresponds with the physical item you intend to trade.
5. Trading only
Grail’s initial trading functionality is for item-for-item trades.
Unless and until Grail expressly introduces a supported payment feature, you must not use Grail’s trade functionality to buy or sell an item for cash, add cash to balance a trade, request monetary payment as part of a trade, or represent an unsupported payment arrangement as being protected or facilitated by Grail.
Any future payment, escrow or fund-hold functionality will be subject to additional or updated terms before it becomes available.
6. Offers and trades
Users may use Grail to propose, discuss, modify and confirm trades.
Discussion of a possible trade does not by itself require either user to complete the transaction.
A trade becomes committed between the users when both users complete the applicable confirmation process within Grail and proceed with the selected exchange method.
The labels and trade states used by Grail may change as the Service develops. This does not change the basic principle that the trade is an agreement between the users involved and not with Munchkin Digital.
Once users commit to a trade, they should act honestly and make reasonable efforts to complete it in accordance with the details confirmed through Grail.
We may retain a record of trade contents, communications, status changes and related activity for safety, moderation, fraud prevention and dispute-management purposes.
7. Postal trades
If both users choose Post as the exchange method, information needed to complete the postal trade may be disclosed between them. This may include each trader’s saved postal address.
A postal address disclosed through Grail may only be used to complete the relevant trade. It must not be published, shared, used for unrelated purposes, or used to contact, threaten, harass or locate another user outside the legitimate requirements of the trade.
Each trader is responsible for appropriately packaging and sending their own item.
Unless Grail expressly states otherwise, users are responsible for their choice of postal or courier provider, tracking, insurance, packaging, declared value and proof of lodgement.
Grail is not a postal or courier service and does not control delivery.
To the extent permitted by law, Munchkin Digital is not responsible for loss, delay, theft or damage occurring while an item is in the possession of a postal, courier or delivery provider, except to the extent the loss results from something for which Munchkin Digital is legally responsible.
Users should retain appropriate postage and tracking evidence until the trade has been completed and any reasonable dispute period has passed.
8. In-person trades
Users may choose to complete a trade in person.
Users are responsible for deciding whether, when and where to meet another user.
We recommend meeting in safe, public locations such as established trading-card stores, other public businesses or suitable police-station meeting locations where available.
Any location displayed or suggested through Grail is provided as a convenience only. Grail does not inspect, supervise or guarantee the safety, suitability or availability of any meeting location.
Users should exercise reasonable caution, inspect items before completing an exchange and leave a meeting if they feel unsafe.
Interactions between users in person remain the responsibility of those users.
9. Inspecting and verifying items
Grail does not authenticate items unless we expressly introduce and describe an authentication service.
Before completing a trade, users should make their own assessment of an item’s identity, authenticity and condition.
For graded cards, users should consider the authenticity and condition of the grading holder and certification. For sealed products, users should consider signs of tampering, resealing or alteration.
Information supplied through Grail should not be treated as a professional authentication, grading or valuation opinion.
10. Prohibited items and conduct
You must not use Grail to offer, request, facilitate or promote counterfeit cards or products, stolen property, fake grading holders or certifications, resealed products represented as factory sealed, proxy or reproduction cards represented as authentic, materially altered cards without appropriate disclosure, items with deliberately undisclosed material damage, fraudulent or misleading listings, or illegal goods or activity.
You must also not use Grail for scams, phishing, harassment, threats, unlawful discrimination, sexually exploitative material, malware, unauthorised access to accounts or systems, unauthorised scraping or harvesting of data, or infringement of another person’s intellectual property, privacy or other legal rights.
You must not manipulate trade history, completion statistics, activity indicators, ratings or other trust features, create fake accounts, coordinate sham trades or otherwise attempt to artificially improve trust metrics.
You must not encourage or require another user to move an active Grail trade off-platform for the purpose of avoiding Grail’s safety, moderation, evidence or trade-record systems.
This does not prevent users from exchanging information reasonably necessary to complete a legitimate postal or in-person trade.
Where practical, substantive trade discussions should remain within Grail so there is an accurate record if an issue later arises.
11. Messaging
Grail provides messaging to facilitate legitimate trading and communication between collectors.
You must not use messaging for spam, harassment, scams, unsolicited commercial solicitation or other conduct prohibited by these Terms.
Messages are not ordinarily public. However, authorised Munchkin Digital personnel may access or review messages where reasonably necessary for moderation, user safety, fraud prevention, customer support, security, enforcement of these Terms, operation of the Service or compliance with legal obligations.
Our handling of messages and personal information is explained further in our Privacy Policy.
12. Reports, disputes and moderation
Users may be able to report users, listings, trades or other activity to Grail.
We may investigate a report using information reasonably available to us, including trade records, uploaded images, account information and relevant communications.
Depending on the circumstances, we may issue warnings, remove content, pause or terminate a trade within Grail, restrict features, suspend an account, permanently disable an account or take no further action.
Moderation decisions concern use of Grail. They are not judicial determinations of ownership, liability, fraud or other legal rights between users.
Grail is not required to compensate either trader because of a moderation decision or user dispute unless required by law.
If you believe an enforcement decision was made incorrectly, you may request review by contacting us at admin@tradeongrail.com.
We may retain relevant information where reasonably necessary to investigate or document serious misconduct, fraud, safety incidents or legal claims.
13. Public trade-binder links
Most account and trading information is available only within Grail according to the applicable product settings.
Grail may also allow you to create a public link to your trade binder.
Anyone who obtains that link may be able to view the information made available through it without creating a Grail account.
Public trade-binder links should not be treated as private or confidential. A person who receives a link may forward it or copy information from it.
We may use technical measures intended to discourage unintended discovery of public-share pages, but we cannot guarantee that information which has already been viewed, copied or republished by another person can later be retrieved or deleted.
14. User content
User Content includes photographs, binder images, profile images, usernames, descriptions, messages and other material you submit through Grail.
You retain ownership of rights you hold in your User Content.
You give Munchkin Digital a non-exclusive, worldwide and royalty-free licence to host, store, reproduce, display, communicate, and technically adapt your User Content where reasonably necessary to operate Grail, display your content according to your settings, provide trading and sharing functionality, maintain safety and security, improve the Service and promote Grail using content you have made public.
For public content used in Grail marketing, this licence may include reasonable use of your public username and profile image where relevant to the content.
We will not use private messages or non-public account information in advertising merely because you have provided that information to Grail.
The licence generally ends when the relevant content is deleted from our active systems, except where retention is reasonably necessary for safety, disputes, backups, moderation or legal obligations, or where the content has already been incorporated into previously published promotional material.
You confirm that you have the rights necessary to upload your User Content and permit us to use it in accordance with these Terms.
15. Grail intellectual property
The Grail name, branding, software, interface, designs and original content created by Munchkin Digital are owned by or licensed to Munchkin Digital.
You may use them only as necessary to use Grail in accordance with these Terms.
Except where permitted by law, you must not copy or commercially exploit Grail’s software or proprietary content, reverse engineer the Service, bypass technical restrictions, create an unauthorised competing database from Grail data, use Grail branding in a way that suggests endorsement or affiliation, or use automated tools to scrape the Service without written permission.
16. Third-party content and trademarks
Trading-card names, characters, artwork, logos, set names, trademarks and related intellectual property may belong to third-party rights holders.
Grail may display such information for identification, reference and trading functionality.
Grail is an independent platform. Munchkin Digital and Grail are not affiliated with, sponsored by, endorsed by or officially connected with The Pokémon Company, Nintendo, Game Freak, Creatures Inc. or any other trading-card publisher or rights holder unless expressly stated otherwise.
All third-party trademarks and intellectual property remain the property of their respective owners.
17. Third-party services
Grail may rely on third-party technology providers to deliver parts of the Service, including cloud hosting, authentication, notifications and mapping.
Availability of those services may affect Grail.
Where you use Apple, Google or another third-party service in connection with Grail, your use of that service may also be governed by that provider’s own terms and privacy practices.
18. Notifications and marketing
Grail may send service communications reasonably necessary to operate your account or trades, including account, security, offer, trade, moderation and safety notifications.
Some essential service communications may not be capable of being disabled while you maintain an active account.
Optional marketing communications and marketing push notifications may be managed or unsubscribed from using the mechanisms we provide.

19. Suspension and termination
We may restrict, suspend or terminate access to Grail where reasonably necessary because you materially or repeatedly breach these Terms, we reasonably suspect fraud or serious misconduct, your activity creates a material safety or security risk, you attempt to circumvent a previous suspension, or we are required to do so by law.
Where appropriate, we may use warnings or feature restrictions before terminating an account. Serious fraud, threats, unlawful conduct or safety risks may justify immediate action.
You may delete your account using the available in-app functionality or by contacting admin@tradeongrail.com.
Deleting your account does not automatically erase information we reasonably need to retain for completed trades, fraud prevention, disputes, moderation, security, legal compliance or legal claims.
Public profile and binder content will be removed from active display following account deletion, subject to reasonable technical processing periods and the exceptions described in these Terms and our Privacy Policy.
20. Availability of Grail
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation.
Grail may occasionally be unavailable because of maintenance, updates, faults, third-party outages, security incidents or circumstances outside our reasonable control.
We may make reasonable changes to Grail as the Service develops.
If we materially change these Terms in a way that significantly affects users’ rights or obligations, we will provide reasonable notice where practicable.
21. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where a guarantee, condition or other right is implied by law and cannot lawfully be excluded, these Terms operate subject to that right.
22. Disclaimers and liability
Subject to section 21 and to the maximum extent permitted by law, Grail provides a platform through which users interact and arrange trades. We do not guarantee the conduct, identity, reliability or honesty of any user.
We do not guarantee that an item offered through Grail is authentic, correctly identified, accurately described, owned by the trader, safely delivered, or that another user will complete a trade.
We also do not guarantee that an item will retain or increase its value or that an in-person meeting will be safe.
Nothing in these Terms limits liability where doing so would be unlawful.
To the extent permitted by law, Munchkin Digital is not responsible for loss caused solely by another user’s conduct, inaccurate information supplied by another user, a user’s decision to trade, a postal or delivery provider, an in-person interaction between users, or a user’s failure to take reasonable safety precautions.
We do not exclude responsibility for loss to the extent it was caused by Munchkin Digital’s own breach of an applicable legal obligation and that liability cannot lawfully be excluded.
23. Third-party claims
If your unlawful conduct, infringement of another person’s rights or material breach of these Terms causes a third party to make a claim against Munchkin Digital, you are responsible for losses and reasonable costs directly resulting from that claim to the extent permitted by law and to the extent those losses were caused by your conduct.
This does not require you to compensate Munchkin Digital for loss caused by Munchkin Digital’s own negligence, breach or unlawful conduct.
24. Privacy
Our Privacy Policy explains how we collect, use, disclose, store and retain personal information.
Certain information may be disclosed to another trader where necessary to complete a trade, including a postal address after Post has been selected as the exchange method.
25. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws.
Nothing in this section prevents you from exercising rights available under mandatory consumer or other applicable laws.
If you have a dispute with Munchkin Digital, please contact admin@tradeongrail.com so we have an opportunity to investigate and attempt to resolve the issue.
If the dispute cannot be resolved informally, either party may exercise the rights available to them under applicable law.
26. General
If any provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
A failure by us to enforce a provision on one occasion does not waive our ability to enforce it later.
You may not transfer your Grail account to another person.
We may transfer our rights and obligations as part of a genuine corporate restructure, sale or transfer of the Grail business, provided that doing so does not remove rights you have under applicable law.
These Terms, together with our Privacy Policy and any Community Rules or safety policies expressly incorporated into them, form the agreement governing your use of Grail.
